Hi,

I have a tenant who refuses to pay the full rent, saying she was off sick, then she lost her job. I agreed to accepting a lower rent for 2 months, but that was 6 months ago,and she is still not paying me the full rent; one month I got nothing!
She is hard to contact and ignores letters.  I served her with a Section 8 Notice hoping she would just leave, but now I am wondering whether it should have been a Section 21 as a mental health charity are now trying to negotiate a payment plan with me. They claim she has tried to contact me to offer me some cash up front and this is simply a lie. If I take her to court on a S8 and she comes up with some cash, then could I loose the case? My aim now is to just get my property back so that I can clean it up again. Can I now issue a S21?

Personally I would say this one is tricky enough to warrant paying the solicitor to sort out.
It is expensive but its even worse when something has been omitted on the form and 3 months down the line you find you are back at the beginning

I agree with Jeffo. Seek legal advice, it will probably be a lot quicker/cheaper than the other alternatives.
