HMO liscence query

I have just found out that though all other conditions are met, my hmo liscence for my 2 bed flat (required for any shared rented household, 2 or more people, in the area) is likely to be refused due to lack of appropriate planning permission (for various reasons this was not highlighted during the liscence application 12 months ago) so I had not been aware that this was a requirement until the letter giving 21 days to appeal the refusal.
I believe I may need to serve a section 21 to the current tenants as well as appealing the refusal and making the application for the planning permission immediately which shows my intent to make this right?
If anyone has any information which may be helpful in helping me navigate this difficult and stressful situation this would be great fully received.

What exactly is the "appropriate planning permission" that is currently lacking?

BTW, it's "licence", not "liscence"

Apologies that my post was not very clear. The local area does not define hmos as domestic properties, therefore the planning permission application required is for 'change of use'. All other requirements have been met, and the flat is in good condition... no building works etc required to my knowledge. My concern is the legal position for myself and the tenants if the appeal is declined. I believe the appeal I'm trying to make is a request for time to complete the application... I just wondered if anyone had ever dealt with a similar situation and had advice.

You probably need to serve notice quickly in case the appeal fails. You can't serve a valid s21 notice for an HMO with no license.
